Fix Auto 2025 Customer Experience Survey Contest (the “Contest”)

Official Contest Rules and Regulations (the “Rules”)

1. HOW TO PARTICIPATE

Contest Sponsor: Fix Auto Canada Inc.

Contest Period: The Contest begins at 12:00 am (PST) on the first day of each month and ends at 11:59 pm (PST) on the last day of each month (the “Entry Period”), between January 1, 2025 and December 31, 2025. The Contest is open to all legal residents of Canada of the age of majority in their province/territory of residence, except franchisees, employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of the Sponsor, its parent companies, subsidiaries, affiliates and related companies, as well as Head Office employees of the Sponsor and their respective advertising and promotion agencies, suppliers and the independent judging organization (collectively, the “Contest Parties”). The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy.

Contest Entry: Customers receiving service from a participating Fix Auto body shop will be provided with a survey invitation and a barcode (the “Survey Access Code”), on their sales receipt. To enter, customers must complete an online survey at http://fixautoopinion.com (the “Website”), using the provided Survey Access Code. Completion of the survey will automatically enter the customer (the “Entrant”), into the Contest (the “Entry”). Entrants are encouraged to retain their sales receipt or invoice for validation should they be selected for the chance to win a prize.

No Purchase Entry: Mail a blank piece of paper to: Fix Auto Canada Inc., 99 Émilien-Marcoux, suite 101, Blainville, Québec J7C 0B4, Attention: “Fix Auto 2025 Customer Experience Survey Contest”, and include your full name, address, e-mail address, telephone number and a unique and original essay of minimum 50 words (the “Essay”) about why you should win a Prize (as defined below). There is a limit of one (1) no purchase Entry per unique and original Essay, as determined by the Sponsor in its sole and absolute discretion, during each Entry Period.

Entry Limit: All entries are collectively referred to as “Entries”. There is a limit of one (1) Entry per Entrant, per Entry Period, for a total of nine (9) Entries during the Contest Period. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the Entry is not fully completed and submitted during the applicable Entry Period. Use (or attempted use) of any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (as defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void). All Entries are subject to verification at any time for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

 2. PRIZES

Prizes: There will be a total of nine (9) prizes available to be won during the Contest Period, each to be awarded in the form of a cheque in the amount of $1,000 CAD (each, a “Prize”). Any depiction of Prizes is for illustrative purposes only. All Prizes must be accepted as awarded and are not transferable or assignable. No substitutions except at Sponsor’s option. The Sponsor reserves the right to substitute a Prize with one of equal or greater value. Limit of one (1) Prize per Entrant/family/household per ninety (90) days. Winners are solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included.

Winner Selection: There will be a computerized random draw (the “Draw”), at 10:00 am (PST) on the fifteenth (15th) day of the month following the end of each Entry Period (the “Draw Date”), to select one (1) Entrant from all eligible Entries collected during such Entry Period. The Entrant selected on the Draw Date will be eligible to receive the Prize. Unselected Entries from one Entry Period do not carry over into the next Entry Period. The Draw Dates during the Contest Period are as follows:

The odds of winning depend on the total number of eligible Entries received during each Entry Period. The Draw will be carried out by a Contest administrator, the judge of this Contest, whose decisions are final and binding. The Contest administrator will make two (2) attempts to contact the selected Entrant within five (5) business days following the Draw Date, by telephone or email at the phone number or email address used to enter the Contest. Should the selected Entrant not reply to the Contest administrator by email or telephone within five (5) business days of notification, there is a return of any notification as undeliverable, or the selected Entrant is found to otherwise not comply with the Contest requirements and/or the Rules, that selected Entrant will be deemed to have forfeited any rights to his or her Prize and the Contest administrator will have the right to select an alternate potential winner from among the remaining eligible Entries for that Entry Period. Before being officially declared a contest winner, the selected Entry must be verified by the Contest administrator. The Contest Sponsor and the Contest administrator reserve the right to require proof of age and compliance with these Rules prior to awarding any Prize. The Contest Sponsor retains the right, in its absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of the Prize for any reason. The decisions of Contest Sponsor on all issues relating to the Contest will be final and binding on all Entrants.

Claiming the Prize: Winners shall be required to present themselves at the Fix Auto body shop where the survey invitation was issued in order to claim the Prize.

BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, the selected Entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return, within ten (10) business days of notification, the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected Entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entrant from among the remaining eligible Entries received during the Contest Period (in which case the foregoing provisions of this section shall apply to such new selected Entrant).

3. GENERAL RULES

Intellectual Property: All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

All surveys and Entries become the property of the Sponsor. Neither the Sponsor nor any organization involved in organizing the Contest shall be responsible for any Contest documentation that is unreadable, illegible, incomplete, lost, stolen, misdirected, not received, destroyed, or delayed for any reason whatsoever.

Discrepancy: In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Entry, Website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.

General Conditions:

  1. The Releasees will not be liable for: (i) any failure of the Website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an Entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.
  2. The Releasees assume no responsibility for lost, delayed, incomplete or misdirected Entries. No correspondence will be entered into except with the selected Entrant who will be notified by telephone or email and informed of all necessary arrangements. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or Entrants.
  3. In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned the selected email address by an internet provider. An Entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry.
  4. The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
  5. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole discretion, to disqualify any Entrant’s Entry in the Contest or entitlement to the Prize, if the Sponsor, in its sole discretion, determines or suspects that the Entrant has attempted to undermine the legitimate operation of the Contest by cheating, hacking, deception, use of multiple mice or other fraudulent, deceptive or unfair playing practices (including, without limitation, any Entries generated by script, macro, robotic, programmed, or any other automated means). Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will automatically be disqualified.
  6. By entering this Contest, each Entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at https://fixauto.com/ca-on/en/index.snc), unless the Entrant otherwise agrees.
  7. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
  8. Should an Entrant wish to not be entered into the Contest following completion of the Entry, they should send an email to customer.service@fixauto.com to request that their Entry be rendered null and void.
  9. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
